Digital Nomad Spanish Visa

PRACTISE AREAS

Digital Nomad Spanish Visa

Non-EU citizens can apply for a residence permit for international remote work (Digital Nomad Visa) to engage in a labour or professional activity remotely for companies located outside the national territory, using exclusively computer, telematic, and telecommunication means and systems.

In the case of labour activity, the holder of the international remote work authorization can only work for companies based outside the national territory.

In the case of professional activity, the holder of the authorization is allowed to work for a company located in Spain, as long as the percentage of this work does not exceed 20% of their total professional activity.

Requirements:

  • Proof of being a graduate or postgraduate, having professional training, or a minimum of three years of professional experience.
  • Proof of real and continuous activity by the company with which the applicant contracts.
  • Documentation proving that the labour or professional relationship can be carried out remotely.
  • Proof that the labour or professional relationship between the applicant and the worker has existed for at least three months, as well as documents proving the terms and conditions of the remote activity.

The permits granted and their duration vary depending on the applicant’s situation:

Visa

When the applicant is outside Spain, they will obtain a permit to reside and work throughout the national territory. The duration of the permit is one year, unless the work period is shorter, in which case the visa will have the same duration.

After one year, the applicant must apply for a residence authorization.

Residence Authorization

When the applicant is legally in Spain, they will obtain a permit for three years to reside and work throughout the national territory.

Where to submit the residence application? Visas are submitted at the Spanish Diplomatic Missions and Consular Offices in the applicant’s place of origin. The residence authorization is submitted to the Large Companies and Strategic Groups Unit.

Family members, spouses, and children can jointly apply for residence as dependents of the digital nomad. This residence will allow family members to work, either as employees or self-employed.
